L is a student of a university / technical college. Proof of membership was provided by a student confirmation.

The parties Z and L agree:



1. Z is the sole and unrestricted owner of all rights to GABEK® and WinRelan® (hereinafter referred to as G). Further developments (method, etc.) are decided exclusively by Z.



2 Scope of the license. L is entitled to use G exclusively for scientific objectives for a maximum of one year.

L uses G as part of the specified project.

After the expiration of time or in the case of further application, e.g. with an economic objective, L undertakes to conclude a licensing agreement for the professional use of G with Z. This also applies to projects which are carried out against payment for third parties or for subsidized research projects which are regarded as professional projects. L must inform Z immediately. L also informs its client/subsidy provider for whom a project is planned about the licensing obligation towards Z, obtains its consent and concludes a corresponding licensing agreement with Z.

L receives all documents necessary for the application of GABEK® and WinRelan®, Z is not liable for the quality of G. In case of software or hardware incompatibilities during installation, already paid license fees are refunded. The refund requires that the operating system and software constellation of L have been described, which presumably led to the installation problem.



3. Obligations of the licensee. L reports on request by Z about essential experiences (errors, desirable improvements, etc.), in particular about

Improved and new application possibilities

For publications about the project as well as for master theses, diploma theses or dissertations, L undertakes to provide the corresponding bibliographic information Z. In any information of search terms about an undergraduate thesis or about project reports and publications, "GABEK" must in any case also be specified as a literature search term. WinRelan® is methodical and tested in various applications. As with all programmes of this kind, however, it cannot be completely ruled out that incompatibilities can occur. In the event of problems in special applications, L undertakes to immediately document all occurring errors in such a way that program-technical processing is possible without problems. (Normally, it is sufficient to send the corresponding WinRelan® documents, which were stored shortly before the error and after the error occurred, and the corresponding log.files with a detailed description of the problem area.) When the method is first mentioned, the copyright for GABEK® and WinRelan® must be indicated in research projects and publications: GABEK® and WinRelan® (Copyright © Josef Zelger, Innsbruck).



4. L transfers to Z a license fee as indicated in the order form, to Josef Zelger, to the account No. 210 203 285 at Landeshypothekenbank Tirol, IBAN: AT54 5700 0002 1020 3285, BIC (SWIFTCODE): HYPTAT22.

The introduction to G and supervision services by Z or an employee commissioned by Z are billed at the usual rates. For renewal of the licence for subsequent years see www.GABEK.com



5. safeguards.

5.1.L undertakes to comply with the regulations for the use of G. In particular, L must also comply with the measures for data protection and data security (virus protection, backups, etc.). L is not entitled to make changes to G of any kind. Z must be informed immediately of the wish for such a change. L is not entitled to back-develop or decompile the WinRelan® software (reverse engineering, decompilation and disassembly). He/she is also liable if this is done by a third party who has received WinRelan® from L. L undertakes to use G in such a way that neither G nor unpublished documents (e.g. preprints, training material) can reach third parties via G. However, preprints and manuals can be cited. L is not entitled to disclose documents about G, not even for information purposes. L is not entitled to provide training on G or to provide supervision services on GABEK® projects. This requires special training and the conclusion of a separate license agreement. This is especially true for the WinRelan® software. Prior agreement with Z is mandatory. L undertakes to install WinRelan® in such a way that it is not accessible to any persons other than those provided for in the contract. This licence is an end-user licence. L is fully liable for all damages resulting from non-compliance with the contract.



6. Final provisions

6.1. The contract begins with the submission of the software and the license file, and ends after one year. Follow-up agreements see www.GABEK.com

The parties Z and L agree:



1. Z is the sole and unrestricted owner of all rights to GABEK® and WinRelan® (hereinafter referred to as G). Further developments (method, etc.) are decided exclusively by Z.



2 Scope of the license. L is granted the right to use G for projects with scientific objectives of the specified organization, hereinafter called organization O.

The use authorization is generally limited to the duration of the CAMPUS license, i.e. applies for a maximum of one year, but is automatically extended if L is still a student / employee or member of the organization whose CAMPUS license is renewed.

L uses G as part of the specified project.

After the expiration of time or in the event of further application, e.g. for projects outside the aforementioned organization O, L undertakes to conclude its own license agreement with Z. This also applies to projects carried out on behalf of L against remuneration for third parties or for subsidised research projects outside the Organisation O. If a project with G is carried out outside the Organisation O of L, L has the licensor Z

inform immediately thereof. L also informs his/her client/subsidy provider for whom a project is planned about the licensing obligation towards Z, obtains his/her consent and concludes a corresponding licensing agreement with Z. L receives all documents necessary for the application of GABEK® and WinRelan®, Z is not liable for the quality of G.

6. Final provisions

6.1. The contract ends after one year, when L leaves Organization O or when the CAMPUS contract of Z with Organization O is terminated.

Additional agreements must be made for further applications.

Agreement for the use of GABEK® and WinRelan® by academic staff at universities and universities of applied sciences. Applicable for academic staff at a university or university of applied sciences with an academic degree (Magister/ra, Master, Doctor) between the contractual partners: Prof. i. R. Dr. Josef Zelger, Klammstraße 7f, A-6020 Innsbruck, Tel. 0043 (0)699 129 11 666, E-Mail Josef.Zelger@uibk.ac.at or its legal successor, hereinafter referred to as Z, and the licensee (hereinafter referred to as L). The parties Z and L agree:

1. Rights and Use: 1.1 Z is the sole and unrestricted owner of all rights to GABEK® and WinRelan® (hereinafter referred to as G). Z alone decides on further developments (methods, etc.). 1.2. GABEK® is methodological, legal and independent of WinRelan® in its application. WinRelan® was developed for GABEK®. WinRelan® may also not be used in parts independently of GABEK® without express consent of Z. Should WinRelan® be used separately from GABEK® with the consent of Z, the same rule applies as for GABEK® as a whole. Every user of GABEK® or WinRelan® or procedures derived therefrom or those that take over parts of GABEK® or WinRelan® is obliged to conclude a license agreement with Z. 1.3 All licence agreements are concluded directly with Z. Sublicences of any kind are excluded. This licence is an end-user licence. 1.4 The WinRelan® work program may not be passed on in principle, even for presentation. However, it may be used by L itself or the employee appointed by L to present the results. The WinRelan® presentation program may also be used to present the evaluated data after termination of the contract. Any other use is contractually excluded. 1.5 L is entitled to bring in an employee when using GABEK and WinRelan.The project employee is also bound by the contractual terms and conditions as L. 1.6 If there are no special reasons, L informs the title of the project Z to be carried out.

2.1 Unless otherwise noted, G is the complete practical procedure, i.e. scientific

is subject to the full license obligation for commercial GABEK® projects. L has Z of them immediately

L informs the institution/organisation or company thereof, obtains their consent and concludes a license agreement with Z for commercial GABEK® projects.

2.6 Scope of the License Service. L receives the eligibility to use G exclusively for scientific objectives up to a maximum of one year.L uses G within the specified project. After the expiration of time or in the case of further application, e.g. with an economic objective, L undertakes to conclude a licensing agreement for the professional use of G with Z. This also applies to projects which are carried out against payment for third parties or for subsidized research projects which are regarded as professional projects. L must inform Z immediately. L also informs its client / subsidy provider for whom a project is planned about the license obligation towards Z, obtains its consent and concludes a corresponding license agreement with Z.3. Initial applications by the licensee: services such as training, hotline, project support and other GABEK®-related services are invoiced separately if claimed (see the corresponding offers at www.GABEK.com)

4. Guarantee. Other services: 4.1.WinRelan® is methodical and tested in various applications. As with all programmes of this kind, however, it cannot be completely ruled out that incompatibilities can occur. In case of software incompatibilities during installation, already paid license fees are refunded. The refund requires that the operating system and software constellation of L have been described, which presumably led to the installation problem. 4.2 In the event of problems in special applications, L undertakes to immediately document all occurring errors in such a way that program-technical processing is possible without problems. (Normally, it is sufficient to send the corresponding WinRelan® documents, which were stored shortly before the error and after the error occurred, and the corresponding log.files with a detailed description of the problem area.) 4.3 Warranty can only be assumed by Z if all instructions regarding the procedure and data backup have been followed exactly and this is proven beyond doubt. The guarantee shall be limited to a maximum of the amount of the licence payment for the part of the individual application concerned on page 1. Disadvantages that could arise from the advice and program application by L are not at the expense of Z. If L carries out a GABEK® project on behalf of third parties, then L itself ensures adequate insurance protection. 4.5.G will be further developed in basic research and after the experience of widespread practical applications. In the case of agreements on the renewal of the contract, L always receives the latest version of the software.

5. Obligations of the Licensee: 5.1.L is obliged to pay a license fee in accordance with the contract. 5.2. L is not authorized to represent Z. It uses G in the latest version specified by Z. 5.3. L is obligated not to fall below the minimum expenses agreed with Z during project implementation and the minimum prices applicable thereto for GABEK® services (assurance of the quality of service). 5.4.L undertakes to comply with the regulations for the use of GABEK, in particular the WinRelan® software and all work equipment. L also has to strictly comply with all measures regarding data protection (legal regulations, usage, securing data from unauthorized knowledge etc.) and data protection (viruses, security storage etc.). L is liable for all damages arising from non-compliance 5.5. L informs Z about the persons (names, addresses, e-mail) involved in the GABEK® project. The customer of L must be informed by the licensee about the license agreement concluded with Z.

6. License Fees for G: 6.1. Z receives a License Fee as indicated in the Order Form 6.2. If L has an International Company or a consulting firm as a client for a GABEK® project, or if L’s contract relates to a number of projects, then this contract for the use of GABEK is not applicable. In such a case, a separate license agreement for projects in the commercial economy and public administration (Licence Institutional) is negotiated by Z with L. This also applies to GABEK®-WinRelan® training courses conducted exclusively by Z.

7. Payment. 7.1 The license fee is paid according to the invoice upon conclusion of the contract between L and Z. The access data for downloading G or the WinRelan® program are sent to L after payment. 7.2 L transfers the license fee to Z as indicated in the order form, to Josef Zelger, to the account No. 210 203 285 at Landeshypothekenbank Tirol, IBAN: AT54 5700 0002 1020 3285, BIC (SWIFTCODE): HYPTAT22.

8. Protective provisions: 8.1. L is not entitled to make any changes to G of any kind. Z must be informed immediately of the wish for such a change. L is not authorized to reverse develop or decompile the WinRelan® software (reverse engineering, decompilation and disassembly). He is also liable if this is done by a third party who has received WinRelan® from L. This licence is an end-user licence. 8.2.L undertakes in particular to pass on G, which are content method, method of operation, work equipment, etc. and the program WinRelan® in no way, even partially and for information, to third parties. L undertakes to use G in such a way that unpublished documents about G (e.g. preprints, training materials), in particular WinRelan®, cannot reach third parties. However, preprints and manuals may be cited. However, for the execution of the contractual application, L may entrust a trusted employee named Z beforehand with an address to work on WinRelan® (whose name is specified in the contract above). The latter, in turn, undertakes to comply with the above-mentioned conditions. In addition, L does not have the right to transfer the know-how to third parties. 8.3 Neither L nor any employee commissioned by L is entitled to conduct training on G. This requires special training and the conclusion of a separate license agreement with Z. This applies especially page 2 for the software WinRelan®. Prior agreement with Z is mandatory. 8.4.L undertakes to install WinRelan® in such a way that the Program is not accessible to any persons other than those provided for in the contract. 8.5. L is fully liable for all damages arising from non-compliance with this contract for Z or for third parties.

9. The further development and quality assurance (method and application) of GABEK® are essentially supported by the experience gained from practical applications. L grants Z, upon request, access to the course and results of the application. Z is subject to the obligation to maintain the confidentiality owed to the client by L. However, the client of L can release Z. Upon request from Z, L reports on essential experiences (errors, desirable improvements, etc.) and in particular also on the type and extent of verbal data material, above all on -tasks - process steps carried out - evaluation strategies - questions encountered during implementation and in particular presentation, -difficulties and their overcoming -procedural improvements and new application possibilities. In the case of publications on the project, L undertakes to provide the corresponding bibliographic information Z. Z may include L and its client as well as the project title as a reference in the GABEK project list, provided there are no counter-reasons.

10. Use of the designations GABEK® and WinRelan®. Advertising activities. For project descriptions, presentations, project reports and publications about the contract project, Univ.-Prof. Dr. Josef Zelger is to be mentioned as the author and rightholder of Method G. The copyright of GABEK® and WinRelan® must also be printed as follows: GABEK® and WinRelan® (Copyright © Josef Zelger, Innsbruck). But it must be made clear that the responsibility for implementation in the specific case lies with L, unless otherwise agreed. 10.2. In any information about search terms in project reports or publications about the project, “GABEK” must in any case also be specified as a literature search term. 10.3. advertising measures in connection with G must be coordinated with Z beforehand. In the event of an infringement, the licence shall be suspended.

Final Clauses: 11.1. The contract shall end one year after the conclusion of the contract. 11.2. For a time extension, follow-up agreements must be made (see www.GABEK.com ) 11.3. The contract can be terminated for important reasons (initiation of settlement or bankruptcy proceedings, late payment, violation of contract provisions, non-competition, etc.). 11.4. In any event, the contract ends with the cessation of business activities of L. 11.5. Changes to the contract require written form. If contractual parts are ineffective, they will be replaced by the contractual partners by legally valid provisions. The other provisions shall remain unaffected. 1.4 The WinRelan® work program may not be passed on in principle, even for presentation. However, it may be used by L itself or the employee appointed by L to present the results.

The WinRelan® presentation program may also be used to present the evaluated data after termination of the contract. Any other use is contractually excluded.

1.5 L is entitled to bring in two employees when using GABEK and WinRelan.

The project staff member is also bound by the contractual obligations. In the event of a breach of confidentiality by an employee, L is liable.

1.6 If there are no particular reasons, L will communicate the title of the first implemented project Z



2. Scope and duration of the licences:

2.1 Unless otherwise noted, G means the complete practical procedure, i.e. scientific principles, procedure, the PC program WinRelan® and, if applicable, other tools of the application (manuals, instructions, etc.) according to the respective status.

2.2. The licence is limited to one year.

2.3 L receives all documents necessary for the application of GABEK® and the

current program version of WinRelan®.

2.4 The commercial license entitles L to apply GABEK to subsidized or unsubsidized scientific or commercial projects. L informs its cooperation partners about the license agreement with Z.

2.5 It entitles L to carry out GABEK projects on its own behalf against payment to third parties and to invoice its cooperation partners for the implementation in order to finance its own expenses and to make a profit through the implementation of the project.



3. Initial applications by the licensee:

Services such as training, hotline, project support and other GABEK®-related services are invoiced separately if claimed (see the corresponding offers at www.GABEK.com)

If L has an International Company or a consulting firm as a client for a GABEK® project, or if L’s contract relates to a number of projects, then this Agreement for the professional use of GABEK is not applicable. In one

in such a case, a separate license agreement for projects of the commercial economy and the public administration (Licence Institutional) is negotiated by Z with L. This also applies to GABEK®-WinRelan® training courses conducted exclusively by Z.

However, L may entrust two Z trusted employees previously designated with an address to work on WinRelan® (whose names are specified in the contract above). In turn, they undertake to comply with the above-mentioned conditions. In addition, L does not have the right to transfer the know-how to third parties.

8.3 Neither L nor any employee commissioned by L is entitled to conduct training on G. This requires special training and the conclusion of a separate license agreement with Z. This is especially true for the WinRelan® software. Prior agreement with Z is mandatory.

8.4.L undertakes to install WinRelan® in such a way that the Program is not accessible to any persons other than those provided for in the contract.

8.5. L is fully liable for all damages arising from non-compliance with this contract for Z or for third parties.



9. Exchange of experience:

9.1. The further development and quality assurance (method and application) of GABEK® are essentially supported by the experience gained from practical applications. L grants Z, upon request, access to the course and results of the application. Z is subject to the obligation to maintain the confidentiality owed to the client by L. The contracting entity of:

10. Use of the designations GABEK® and WinRelan®. Advertising activities

10.1. For project descriptions, presentations, project reports and publications about the contract project, Univ.-Prof. Dr. Josef Zelger can be mentioned as the author and rightholder of Method G. The copyright of GABEK® and WinRelan® must also be printed as follows: GABEK® and WinRelan® (Copyright © Josef Zelger, Innsbruck). But it must be made clear that the responsibility for implementation in the specific case lies with L, unless otherwise agreed.

10.2. In any information about search terms in project reports or publications about the project, “GABEK” must in any case also be specified as a literature search term.

10.3. advertising measures in connection with G must be coordinated with Z beforehand. In the event of an infringement, the licence shall be suspended.



11. Final clauses:

11.1. The contract shall end one year after the conclusion of the contract.

11.2. For a time extension, follow-up agreements must be made (see www.GABEK.com )

11.3. The contract can be terminated for important reasons (initiation of settlement or bankruptcy proceedings, late payment, violation of contract provisions, non-competition, etc.).

11.4. The contract ends in any case with the cessation of business activities of L.

11.5 Changes to the contract require written form. If parts of the contract are ineffective, they will be replaced by the contracting parties by legally valid provisions. The other provisions shall remain unaffected.

12. Innsbruck is agreed as the place of jurisdiction.

between the contractual partners: Prof. i. R. Dr. Josef Zelger, Klammstraße 7f, A-6020 Innsbruck, Tel. 0043 (0)699 129 11 666, Email Josef.Zelger@uibk.ac.at or its legal successor, hereinafter referred to as Z, and the licensee (hereinafter referred to as L).

L is a student of a university / technical college. Proof of membership was provided by a student confirmation.

The parties Z and L agree:



1. Z is the sole and unrestricted owner of all rights to GABEK® and WinRelan® (hereinafter referred to as G). Further developments (method, etc.) are decided exclusively by Z.



2 Scope of the license. L is entitled to use G exclusively for scientific objectives for a maximum of one year.

L uses G as part of the specified project.

After the expiration of time or in the case of further application, e.g. with an economic objective, L undertakes to conclude a licensing agreement for the professional use of G with Z. This also applies to projects which are carried out against payment for third parties or for subsidized research projects which are regarded as professional projects. L must inform Z immediately. L also informs its client/subsidy provider for whom a project is planned about the licensing obligation towards Z, obtains its consent and concludes a corresponding licensing agreement with Z.

L receives all documents necessary for the application of GABEK® and WinRelan®, Z is not liable for the quality of G. In case of software or hardware incompatibilities during installation, already paid license fees are refunded. The refund requires that the operating system and software constellation of L have been described, which presumably led to the installation problem.



3. Obligations of the licensee. L reports on request by Z about essential experiences (errors, desirable improvements, etc.), in particular about

For publications about the project as well as for master theses, diploma theses or dissertations, L undertakes to provide the corresponding bibliographic information Z. In any information of search terms about an undergraduate thesis or about project reports and publications, "GABEK" must in any case also be specified as a literature search term. WinRelan® is methodical and tested in various applications. As with all programmes of this kind, however, it cannot be completely ruled out that incompatibilities can occur. In the event of problems in special applications, L undertakes to immediately document all occurring errors in such a way that program-technical processing is possible without problems. (Normally, it is sufficient to send the corresponding WinRelan® documents, which were stored shortly before the error and after the error occurred, and the corresponding log.files with a detailed description of the problem area.) When the method is first mentioned, the copyright for GABEK® and WinRelan® must be indicated in research projects and publications: GABEK® and WinRelan® (Copyright © Josef Zelger, Innsbruck).



4. L transfers to Z a license fee as indicated in the order form, to Josef Zelger, to the account No. 210 203 285 at Landeshypothekenbank Tirol, IBAN: AT54 5700 0002 1020 3285, BIC (SWIFTCODE): HYPTAT22.

The introduction to G and supervision services by Z or an employee commissioned by Z are billed at the usual rates. For renewal of the licence for subsequent years see www.GABEK.com



5. safeguards.

5.1.L undertakes to comply with the regulations for the use of G. In particular, L must also comply with the measures for data protection and data security (virus protection, backups, etc.). L is not entitled to make changes to G of any kind. Z must be informed immediately of the wish for such a change. L is not entitled to back-develop or decompile the WinRelan® software (reverse engineering, decompilation and disassembly). He/she is also liable if this is done by a third party who has received WinRelan® from L. L undertakes to use G in such a way that neither G nor unpublished documents (e.g. preprints, training material) can reach third parties via G. However, preprints and manuals can be cited. L is not entitled to disclose documents about G, not even for information purposes. L is not entitled to provide training on G or to provide supervision services on GABEK® projects. This requires special training and the conclusion of a separate license agreement. This is especially true for the WinRelan® software. Prior agreement with Z is mandatory. L undertakes to install WinRelan® in such a way that it is not accessible to any persons other than those provided for in the contract. This licence is an end-user licence. L is fully liable for all damages resulting from non-compliance with the contract.



6. Final provisions

6.1. The contract begins with the submission of the software and the license file, and ends after one year. Follow-up agreements see www.GABEK.com
